Presumption of conformity and legal warranty on a used vehicle

For a used vehicle purchased from a professional, any defect appearing within the first twelve months is presumed to have existed at the time of delivery. Beyond this period, it is up to the buyer to prove that the defect was present at the time of purchase. In practical terms, if a turbo fails in the fifteenth month, you will need to finance a contradictory expertise to demonstrate the pre-existence.

This distinction between warranty duration and presumption duration radically changes the purchasing strategy. Technical inspection and mechanical points of vigilance when purchasing

A technical inspection of less than six months is mandatory for any sale between individuals. However, a favorable technical inspection does not guarantee the actual mechanical condition of the vehicle. The inspection does not check engine compression, the internal condition of the gearbox, or the wear of the injectors.

We regularly observe vehicles that have passed the inspection without major failures but show clear signs of mechanical neglect. Here are the points that the technical inspection does not cover and that deserve targeted inspection:

  • The condition of the timing (chain or belt): on belt engines, a late replacement can cause total engine failure. Check the last replacement invoice and cross-reference the mileage with the manufacturer’s recommendation.
  • The play in the tie rods and steering joints: a steering wheel that slightly floats at stabilized speed often indicates worn bushings, which are not penalized in the inspection as long as the play remains below the regulatory threshold.
  • The color and viscosity of the engine oil: thick black oil on a vehicle that is supposed to have been recently serviced indicates either a lie about the oil change date or abnormal oil consumption.
  • The operation of the pollution control system (EGR valve, particulate filter): a turned-off check engine light does not mean that the particulate filter has not been removed or pierced. A quick OBD diagnosis reveals erased fault codes.

An OBD electronic diagnosis costs a few dozen euros at an independent garage. Refusing this diagnosis before purchase is like signing a blank check.

Sale between individuals: transfer certificate and administrative traps

The transfer certificate (Cerfa form 15776) remains the pivotal document for any transaction. An error on the transfer certificate blocks registration on the ANTS website, sometimes for several weeks.

The most common errors we observe include: a discrepancy between the mileage recorded on the certificate and that of the technical inspection, a missing signature from the co-owner when the registration document mentions two names, or an uninitialed correction. Each anomaly generates an automatic rejection by the SIV system.

From the seller’s side, the transfer declaration must be registered online within fifteen days. Without this formality, you remain legally responsible for the vehicle. If the buyer commits an offense or an accident before registering it in their name, the fines and civil liability revert to you.

Documents to gather before the transaction

In addition to the transfer certificate, the seller must provide the crossed-out registration document with the mention “sold on” followed by the date and time, the valid technical inspection report, and a certificate of administrative situation (non-pledge) dated less than fifteen days ago. This last document certifies that the vehicle is neither pledged nor under opposition.

Sale price and negotiation in a contracting market

The used car market shows a continuous downward trend since spring 2026, with monthly declines compared to the previous year and a contraction of about 4% over the first eight months. For a seller, setting a realistic price from the moment of listing avoids stagnation.

Recent vehicles aged two to five years are significantly less available on the market, which maintains their relative prices. One last point on seasonality: convertibles and small city cars sell better in spring. SUVs and all-wheel-drive vehicles find buyers more easily in autumn. Publishing an ad at the right time reduces the selling time by several weeks.

The decline in volumes in 2026 makes each sale more demanding. A complete administrative file, an OBD diagnosis performed before the transaction, and a price aligned with current valuations make the difference between a sale that drags on and a sale concluded in a few days.
